Aadhaar Is Not A Sure Proof, Supreme Court Big Decision On SIR: The Supreme Court has made it clear that the Aadhaar card cannot be considered as the final and definitive proof of residence. Especially, during the Special Intensive Revision (SIR) process going on in Bihar.

Senior advocate Kapil Sibal, who appeared for Rashtriya Janata Dal (RJD) leader Manoj Jha in the Supreme Court, said that people keep Aadhaar, ration, and voter identity cards (EPIC). But the officials are not considering it as solid proof of anything.

‘Aadhaar is not conclusive evidence’

On this, Justice Suryakant said that these documents can show that you live in an area, but they cannot be called conclusive evidence. During the hearing, Kapil Sibal alleged that there are many discrepancies in the voter list, such as people who were declared dead are alive, and those who were declared alive have also been found dead.

A bench of Justices Surya Kant and Joymala Bagchi said that this dispute has arisen due to the lack of trust between the Election Commission and the opposition. Justice Kant also said that it would be too broad to say that no one in Bihar has valid documents.

Argument of Election Commission’s lawyer

Election Commission’s counsel and senior advocate Rakesh Dwivedi said that in such a large-scale exercise, it is natural to have some errors, but these can be rectified before the final list is released on September 30.

Let us tell you, opposition leaders and social organizations had challenged the decision of the Election Commission on June 24. On July 29, the Supreme Court had warned that if voters were excluded on a large scale, it would immediately intervene.

What is the concern of the opposition?

Let us tell you, the draft voter list has been released on August 1, while the final list will come on September 30. On this, the opposition says that due to this process, crores of valid voters can be deprived of the right to vote. The petitions have been filed jointly by RJD, TMC, Congress, NCP (Sharad Pawar), CPI, Shiv Sena (Uddhav Thackeray), JMM, CPI (ML), along with PUCL, ADR, and Yogendra Yadav.
